90 Day Fiancé: Happily Ever After?’s Ashley Martson and Jay Smith are one of the show’s most notorious couples, and fans are left wondering if they are divorced and if that means deportation for Jay. When viewers last saw them, they were close to separating for good. Fans aren’t sure what the actual status of their relationship is or if Jay is even still in the country, although a recent interview with Ashley may hold the answer.
Ashley and Jay were initially featured on season 6 of 90 Day Fiancé after the two met when Ashley was in Jamaica for a friend’s wedding. A brief, but intense romance followed, and they eventually married in the spring of 2018. Three days after their Las Vegas wedding, Ashley discovered that Jay had sent messages to women on Tinder. At the end of their first 90 Day Fiancé season, Ashley was already having reservations about filing Jay’s green card paperwork, due to the issues regarding his loyalty. Audiences have been following the couple on season 4 of 90 Day Fiancé: Happily Ever After?, where it was revealed that Jay had sex with a woman in the bathroom of a tattoo shop while married to Ashley. When Ashely found out about Jay’s infidelity, she kicked him out of her house, signaling to fans that the already rocky relationship was now over for good.
Even so, on January 11, Ashley filed for divorce - only to withdraw the paperwork after eleven days. Then, in April, Ashley was back on Instagram where she accused Jay of cheating (again), claiming to have caught him in the act. On April 23, she filed for divorce for the second time. Since then, Ashley has checked herself into a women’s retreat and was then hospitalized for 24 hours due to her battle with lupus, which was brought on by stress. On an Instagram Live interview with Johnny Yates in June (via his YouTube channel), Ashley revealed that it had been a couple of months since Jay had moved out of their home. She said:
Meanwhile, Ashley also unveiled some new information concerning Jay’s immigration status. She noted that an Immigration and Customs Enforcement official had come to her home, serving a notice for Jay appear in court. According to Reality TV World, the U.S. Department of Homeland Security documents stated that Jay may be deported because he overstayed his visa. The K-1 visa only gave him license to reside legally in America until June 3, 2018, and the Department of Homeland Security has initiated removal proceedings against him. According to Ashley, she and Jay now have a court hearing scheduled for August 7 in Philadelphia that she expects will result in Jay’s deportation “unless he runs.” In addition, Ashley said there is currently a warrant out for Jay’s arrest, and claimed that he has called offering her money to withdraw the divorce.
“We were not getting along - he was sleeping with multiple women. So, I actually offered to pay two months of his rent to get him out of my house, because he wouldn’t leave my house. I even tried to blame TLC and say, ‘Oh yeah, they dramatize sh*t,’ because I was embarrassed to say that I went back with someone that was on Tinder three days after I got married, because I was an idiot."
Despite the seemingly never-ending cycle of infidelity, divorce, and reconciliation, somehow Ashley and Jay continue finding ways to shock fans of 90 Day Fiancé. It seems that the two are over for good, and Ashley is now trying to better herself and move on from the marriage. The two weren’t able to say much due to the NDA with TLC, so there are definitely plenty of Ashley and Jay surprises in store for fans of 90 Day Fiancé: Happily Ever After? in the remaining episodes of season 4.
